Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ServQual SUSAN platform and related services (collectively, the “Services”) provided by ServQual Limited (“ServQual”, “we”, “our”, “us”). By creating an account or using the Services, you agree to be bound by these Terms.
If you do not agree, do not access or use the Services.
About the Services
ServQual provides the SUSAN platform, training content, assessments, and related cybersecurity, privacy, and compliance services. Certain features may be offered as free trials, paid subscriptions, or professional services.
1.1 Professional Services
In addition to the SUSAN platform, ServQual may provide professional services including cybersecurity and privacy consulting, audits and assessments, implementation support, training, and penetration testing (“Professional Services”).
Professional Services may be governed by a separate statement of work (SOW), proposal, or contract. In the event of any conflict between these Terms and a separate written agreement for Professional Services, the terms of the separate agreement shall prevail.
Eligibility and Accounts
You must be at least 18 years old and have authority to enter into these Terms on behalf of yourself or your organization.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, or fraudulent purposes
- Attempt to gain unauthorized access to systems, data, or accounts
- Upload malware, exploit vulnerabilities, or interfere with service availability
- Reverse engineer, copy, or misuse the Services except as permitted by law
We may suspend or terminate access if you violate these Terms.
Subscriptions, Trials, and Payments
Some Services may be provided under a free trial or paid subscription. Pricing, billing cycles, and applicable taxes will be described at the time of purchase or in a separate agreement.
Unless otherwise stated, fees are non-refundable.
Intellectual Property
The Services, including software, content, designs, trademarks, and documentation, are owned by or licensed to ServQual.
You are granted a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes in accordance with these Terms.
You retain ownership of your data and content.
Customer Data and Privacy
We process personal data in accordance with our Privacy Policy.
These Terms govern service usage only and do not grant consent for marketing communications.
Marketing communications, where applicable, are strictly opt-in and may be withdrawn at any time.
Security
We implement reasonable administrative, technical, and organizational measures to protect the Services and customer data. However, no system is completely secure, and we do not guarantee absolute security.
Third-Party Services
The Services may integrate with third-party services or APIs. ServQual is not responsible for third-party products, content, or services, and your use of them is governed by their respective terms.
Suspension and Termination
We may suspend or terminate your access to the Services if:
- You breach these Terms
- Your use poses a security or legal risk
- Required by law or regulatory authorities
You may terminate your account at any time. Upon termination, your access to the Services will cease.
Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, ServQual shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business, arising out of or related to your use of the Services.
Indemnity
You agree to indemnify and hold harmless ServQual from claims, damages, liabilities, and expenses arising from your misuse of the Services or violation of these Terms.
Changes to the Services or Terms
We may update the Services or these Terms from time to time.
Material changes will be communicated via the platform or website. Continued use of the Services after changes constitutes acceptance of the updated Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
Courts of England and Wales shall have exclusive jurisdiction, unless otherwise required by applicable local law.
